Revere Mugshot Access and Massachusetts Law

Massachusetts law controls when a jail mugshot is public and when it is restricted. A 2010 opinion from the Supervisor of Public Records (SPR10/152) set the rule. Booking photos taken before criminal proceedings begin are public records. Photos taken after a criminal complaint is filed fall under CORI. Sealing Revere Arrest Records

Under MGL c. 276, §§ 100A and 100C, people can petition to seal their criminal records after certain time periods. Misdemeanor records become eligible for sealing 5 years after conviction or release. Felonies require 10 years. Level 1 sex offender records need 15 years. Level 2 and 3 sex offenders cannot seal their records.

When a record is sealed, it no longer appears in standard CORI checks. Any jail mugshots tied to that record also become restricted. Sealed records still exist but are hidden from public view.
