Sealed records complicate things further. Under MGL c. 276, §§ 100A and 100C, misdemeanors can be sealed after 5 years and felonies after 10 years. Once sealed, the mugshot becomes restricted. It still exists but does not show up in public searches. Expungement permanently destroys the record. Both processes need court approval.
